NYC Mayor Unplugs Jay-Z's Secret Performance + Jay-Z Settles $5 Mil 40/40 Club Lawsuit Against Red Sox Slugger


New York City Mayor Bloomberg has nixed a free surprise Jay-Z concert which was set to take place in Manhattan next week.

According to reports, once news of the secret June 21 show leaked the permit process was halted.

"There was discussion of a concert, and ultimately it was decided there would be no permit," said Julianne Cho, spokeswoman for the Mayor's film office. Sources told The Post that a permit for Jay-Z's performance would have been granted only if organizers could keep the show secret, but word of the show leaked out yesterday. "Many permits are granted on the condition that the event is not made public beforehand for capacity and security reasons," Cho said. "This event was made public."

Further reports suggest that the secret performance would gain too much attention prior to Monday.

A Jay-Z performance on the marquee of the Ed Sullivan Theater planned for Monday was axed by the Mayor's Office of Film, Theatre and Broadcasting on Thursday. The NYPD had already asked organizers to front $100,000 to cover overtime for cops and city workers on the night. The concert was supposed to be a surprise, but word of it leaked out on Thursday, ending any chance at a permit.

Last year's 50 Cent Family Day celebration in Queens, New York was also called off by Mayor Bloomberg.

"The G-Unity Foundation and New York Restoration Project are deeply saddened and disappointed to learn that the permit for our upcoming Family Day event was not granted by the City," a statement read. "As a result, Family Day -- scheduled for August 30th -- has been postponed until further notice."

Later this month, Jay-Z will be heading to the BET Awards where he leads all nominees.

Rapper Jay-Z and his wife, Beyonce, will compete in three categories at the 2010 BET Awards. They're both nominated for video of the year, best collaboration and viewers' choice. Jay-Z received two nominations in the video of the year category, which includes newcomers B.o.B and Melanie Fiona. Jay-Z is the top contender with five nominations; he's also up for best male hip-hop artist. Beyonce, Fiona and Alicia Keys, who follow with four nods each, are all up for best R&B female artist. R&B crooner Trey Songz also received four nominations.

Red Sox baseball star David Ortiz agreed to settle the $5 million 40/40 Club trademark infringement case that Jay-Z brought against him.

According to reports, Ortiz is willing to re-name his Forty Forty club in the Dominican Republic and cease its promotion.

After a judge threatened him with a default judgment, Red Sox slugger David Ortiz yesterday sent a lawyer to answer Jay-Z's $5 million-plus trademark-infringement suit, which claims the player ripped off the name of the rap mogul's famed 40/40 Club. And lawyer Philip Touitou told the judge that Ortiz wants to settle the suit, offering to stop calling the club he and his sister opened in the Dominican Republic "Forty Forty" and to pull down a Web site promoting the nightclub, fortyforty.net. Yankee fan Jay-Z's West 25th Street club is named for the milestone of hitting 40 homers and stealing 40 bases.

Reports of the lawsuit landed online last April.

Jay-Z and Juan Perez own 40/40 Clubs in New York City, Atlantic City and Las Vegas and have plans to open further venues in Tokyo and Macau. They have accused Ortiz of trading on the fame, value and goodwill of their name through his club Forty/Forty and its website, www.fortyforty.net, which they say has caused their business "marketplace confusion and damage," the lawsuit said.

The suit also claimed Ortiz had prior knowledge of Jay's club before naming his night spots.

"David Ortiz is fully aware of plaintiff's Manhattan 40/40 Club, since he had been a patron there on several occasions long before he opened his infringing Forty/Forty Club," said the lawsuit filed in Manhattan federal court. Ortiz had no immediate comment on the lawsuit.

Jay owns multiple 40/40 Club venues throughout the United States.

The 40/40 Club is a chain of All-American sports bars and lounges owned by hip hop mogul Jay-Z and partners Desiree Gonzalez and Juan Pérez. The name is borrowed from the baseball term used to denote the exclusive group of Major League Baseball players who have achieved the rare individual feat of recording 40 home runs and 40 stolen bases in a single season.

No further details have been revealed as of now.
